Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the website elephantaiteam.com (the "Site") operated by Elephant AI ("Elephant AI," "we," "us," or "our"). By accessing the Site, booking a Blueprint Call, or submitting an inquiry, you agree to these Terms. If you do not agree, please do not use the Site.

Elephant AI is based in Sherwood Park, Alberta, Canada, and provides services to clients primarily in the United States.

About Us

Elephant AI builds AI Agents, software, and automation systems for organizations across insurance, solar, real estate, and business education, with particular strength in teams that scale on 1099 talent. We work through results-based partnerships rather than a traditional vendor model.

Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal and informational purposes. You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Copy, reproduce, distribute, or create derivative works from Site content without our written permission.
  • Attempt to gain unauthorized access to the Site, its servers, or related systems.
  • Interfere with or disrupt the operation, security, or availability of the Site.
  • Use any automated means to scrape, harvest, or collect data from the Site.

Intellectual Property

All content on the Site, including text, graphics, logos, images, frameworks, and the "Elephant AI" name and marks, is owned by or licensed to us and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you. Ownership of deliverables and work product created during a client engagement is governed by the separate written agreement for that engagement, not by these Terms.

Bookings and Inquiries

Booking a Blueprint Call or submitting an inquiry through the Site lets us learn about your goals and explore whether we are a fit. It does not create a binding agreement, reserve capacity, or obligate either party to proceed. Any engagement begins only when both parties sign a separate written agreement.

Services and Separate Agreements

The Site is informational and does not constitute an offer to sell products or services. Our services, including scope, fees, timelines, performance arrangements, revenue sharing, intellectual property, and confidentiality, are governed exclusively by the separate written agreement entered into between Elephant AI and the client. In the event of any conflict between these Terms and a signed client agreement, the signed client agreement controls for that engagement.

AI Agents and Automation Disclaimer

We design, build, and deploy AI Agents and automation systems. You acknowledge that AI Agents and automated systems are probabilistic technologies that can produce inaccurate, incomplete, or unexpected outputs, and that their performance depends on inputs, integrations, third-party platforms, and ongoing oversight. Any AI-generated output should be reviewed by a qualified person before it is relied upon. Outputs do not constitute legal, financial, insurance, tax, or other professional advice. We do not guarantee that any AI Agent or system will be uninterrupted, error-free, or fit for a specific purpose, except as expressly set out in a signed client agreement.

No Professional Advice

Content on the Site is provided for general informational purposes only and is not professional, legal, financial, or business advice. You should obtain advice appropriate to your circumstances before acting on any information found on the Site. Examples, case references, and outcomes described on the Site are illustrative, and results vary based on factors specific to each business.

Third-Party Services and Links

Our work and the Site may rely on or link to third-party platforms and services that we do not control. We are not responsible for the availability, content, performance, or practices of those third parties, and your use of them may be subject to their own terms and policies.

Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

To the fullest extent permitted by law, Elephant AI and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Site. Our total liability for any claim arising from your use of the Site will not exceed one hundred Canadian dollars (CAD $100). Liability arising from a client engagement is addressed in the applicable signed client agreement. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Elephant AI and its owners, employees, and contractors from any claims, damages, losses, or expenses arising from your breach of these Terms or your misuse of the Site.

Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share personal information. By using the Site, you consent to the practices described in that policy.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts located in Alberta, Canada, and you consent to that jurisdiction. Before initiating any formal proceeding, the parties agree to first attempt in good faith to resolve the matter. Governing law and dispute resolution for a specific client engagement are addressed in the applicable signed client agreement.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date above and post the updated Terms on this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
